Poor communication between the physician and the patient is a root cause leading to filing a medical liability lawsuit. Recently, Thomas Fleeter, MD, and Robert Slater, MD, of the AAOS Medical Liability Committee, spoke with Lee McMullin, CPHRM, about how to talk to patients after an adverse event. Mr. McMullin is senior risk management and patient safety specialist for Cooperative of American Physicians, a physician-owned and governed, California-based medical malpractice liability cooperative that provides medical professional liability protection and risk management services.

If you ask why the Titanic sank, most will say it’s because it struck an iceberg. Yet, when you analyze the case from an engineering angle, we find many causative factors from a small rudder to brittle rivets. In simple terms, “root cause analysis,” or RCA, is a concept whereby if you find and eliminate one singular “root cause” of an event, you will prevent its recurrence. In reality, rarely is there a “root” cause, as the Titanicproves.

Traditionally, readmissions are considered a problem for hospitals because hospitals receive the brunt of the consequences in the form of financial penalties. Going forward, readmissions are going to be an issue for physicians more and more. The major force behind this change is the Affordable Care Act, according to Ann Whitehead, the vice president of risk management and patient safety of the Cooperative of American Physicians’ CAPAssurance program.

The issue of throughput in the ED must be addressed with policies and procedures that ensure patients are not neglected while waiting for a bed, says Dona Constantine, RN, a former ED nurse and senior risk management and patient safety specialist with the Cooperative of American Physicians in Los Angeles. The hospital must have a clear policy that addresses questions such as who is in charge of a patient discharged from the ED but waiting for a bed. Is it the physician the patient has been admitted to, or is it still the physician in the ED?
